That's a load of nonsense to justify their bootlegging. The 28 year term seems to refer to US copyright under the act of 1909, but that's long since been superseded by laws that make renewal unnecessary and that would protect a work of 1970 until 2065. Not that I think that law is constitutional, since Congress is authorized to grant copyright for a "limited term", and the last time I heard of something being available for a limited time, I didn't think it could mean for 95 years.
